Extended Warranty

 

Interested in an Extended Warranty?

AXIL Extended Warranty – You will enjoy a 2 year warranty instead of the standard 1 year limited warranty, depending on the product you purchase. (Extended Warranty must be purchased at the time of original order.)

For XCOR, XCOR SE, XCOR Digital, XPHERE, GS Extreme,  & TRACKR:

      • One Time Covered Replacement. Deductible to be paid for any following replacements during the life of the warranty.
      • Replacement covers all damage such as rain, water, mud, broken, chewed on by your dog, driven over by your truck, shot by your gun - YOU NAME IT, WE’LL REPLACE IT!
      • We ask you return the units to us in whatever state they are in and we will exchange it for you. This warranty does not cover loss or stolen.

Scope of Warranty 
Axil Brands, Inc. (“Axil”) warrants product(s) to be free of defects in material and workmanship for a period of one (1) year from the date of delivery (“Warranty Period”). A dated proof of purchase and/or delivery confirmation is required to establish warranty eligibility. This Warranty covers any defects in material or workmanship under normal use during the Warranty Period. During the Warranty Period, Axil will repair or replace, at no charge, products or parts of a product that prove defective because of improper material or workmanship, under normal use and maintenance.
Axil will only replace or repair the parts of the Product(s) that are defective or fail to meet the specifications or performance criteria set forth in this Warranty or any applicable documentation provided by Axil. The replacement or repair of such Defective Product(s) will be performed in a manner consistent with Axil's service policies and procedures.
This Warranty does not cover any problem that is caused by: (a) conditions, malfunctions, or damage not resulting from defects in material or workmanship; (b) conditions, malfunctions, or damage resulting from negligence, improper maintenance, or modification; or (c) consumable parts, such as batteries, unless product damage has occurred due to a defect in materials or workmanship.
This Warranty is void if the Product(s) has been returned with removed, damaged, or tampered labels or any alterations (including the unauthorized removal of any component or external cover). This Warranty extends only to products purchased from Axil or Axil's authorized resellers and to the original purchaser or gift recipient (where applicable). It is not transferable to any subsequent owner(s) of the Product(s).
Warranty Period 
The Warranty Period for the Product(s) supplied to the Customer by Axil under this Agreement shall commence on the date of delivery of the Product(s) to the Customer and shall continue for a period of twelve (12) months. During the Warranty Period, Axil shall repair or replace, at its option, any Defective Product(s) at no charge to the Customer, provided that:
  1. The Customer notifies Axil in writing of the claimed defect within ten (10) business days of the defect becoming apparent;
  2. The Defective Product(s) are returned to Axil at the Customer's expense for examination and verification of the defect;
  3. The Defective Product(s) have been used only as intended and in accordance with Axil's instructions and have not been modified or altered.

Extended Warranty (Note: I have adjusted the lead-in text for the Extended Warranty to ensure it does not accidentally imply a "purchase date" start for the coverage itself, even though the add-on must be bought at the point of sale.)

Limitation of Liability (I have tightened the limitation clause to ensure it does not conflict with state-specific consumer protection laws regarding the warranty start date.)
In the event any Axil Brands, Inc., product is found to be defective in material, workmanship, or not in conformity with any express warranty for a specific purpose, Axil’s only obligation and your exclusive remedy shall be at Axil’s option, to repair, replace or refund the purchase price of such parts or products upon timely notification of the issue by you and substantiation that the product has been stored, maintained and used in accordance with Axil’s written instructions.
EXCEPT WHERE PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHER WARRANTY OF QUALITY, OR THOSE ARISING FROM A COURSE OR DEALING, CUSTOM OR USAGE OF TRADE, EXCEPT OF TITLE AND AGAINST PATENT INFRINGEMENT.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT OR OTHERWISE, AXIL SHALL NOT BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THE AGREEMENT, THE PRODUCTS, OR THE USE OR INABILITY TO USE THE PRODUCTS, EVEN IF AXIL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, AXIL'S TOTAL LIABILITY TO CUSTOMER FOR ALL DAMAGES OF ANY KIND AND UNDER ANY THEORY OF LIABILITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT AS PROVIDED IN THIS EXPRESS WARRANTY. IN NO EVENT SHALL AXIL BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THIS PRODUCT EVEN IF AXIL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITY OR DAMAGE.
